1) Acceptance

By accessing or using VisibilityIndex.ai (the “Service”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Service.

2) The Service

The Service generates an “AI visibility” audit and related score(s) using automated prompts and retrieval against third-party platforms, including (as available) large language model (LLM) systems and search/retrieval APIs. The Service is intended to help you understand how frequently and where a business/entity may be recommended versus competitors, based on the audit run.

3) Eligibility

You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a company, you represent you have authority to bind that company.

4) Access, tokens, and cookies

Some features require payment. After successful payment, the Service may set an access cookie (for example, vi_token) to authorize your access to paid endpoints and downloads. You are responsible for keeping your device and browser secure. If you share access links or tokens, you may lose control of paid access.

5) Purchases, credits, and fulfillment

When you purchase an audit, you receive the right to run the audit according to the plan/credits shown at checkout. We may enforce run limits, queueing, and job reservation/consumption semantics to prevent abuse and ensure fair use.

You may submit business/entity information (e.g., business name, website, category, location). You represent you have the right to submit this information and that doing so does not violate any law or third-party rights.

8) Third-party services and dependencies

The Service relies on third-party providers (for example: payment processors like Stripe, LLM providers, and search/retrieval APIs). Their availability, output format, pricing, or policies may change without notice. We are not responsible for third-party outages, changes, or inaccuracies.

9) No guarantees; outputs may change

AI systems and search results are dynamic. The same query may produce different results across time, locations, accounts, and engines. The Service does not guarantee any particular ranking, recommendation, traffic, revenue, or business outcome.

We own the Service, including its software, scoring methodology (to the extent protectable), and branding. You receive a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.

12) Your report license

You may use the report internally and share it with your vendors/partners for the purpose of improving your visibility. You may not resell the Service or provide the report as a standalone product to third parties unless you are on an agency/partner plan that explicitly permits this.

13) Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE.

14) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 3 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorney fees) arising out of your use of the Service, your inputs, or your violation of these Terms or applicable law.

16) Suspension and termination

We may suspend or terminate access if we reasonably believe you violated these Terms, abused the Service, or created legal risk. You may stop using the Service at any time.

17) Governing law

These Terms are governed by the laws of New Mexico, without regard to conflict-of-law principles. Venue for disputes will be New Mexico, unless required otherwise by law.

18) Changes

We may update these Terms from time to time. The “Effective date” above reflects the latest revision. Continued use after changes means you accept the updated Terms.
